3.    Do you keep a copy of the photos / videos etc. If we need to get access to them later?

We store the files for 90 days and after that it is the clients’ responsibility to have the media files downloaded to their computer.

There is an exception to this rule, when you purchase a listing website with us, the files are stored on the client portal through the website/delivery for 1 year.

4. Photos, Copyright / Ownership of Materials

In Canada when creative work is purchased it is generally viewed that you are purchasing the rights to use the work, not the ownership of the assets unless stated otherwise in writing.

Using the photos for the intended use “MLS Listing” is permitted, using them for your Advertisements is permitted, basically you as the agent purchased the rights to use them. The assets are not transferrable to other agents. Example, you have listed the property and for some reason the home didn’t sell, or you have to step away from this listing. Another agent takes it on as a new listing, the agent cannot simply use the old files and post it for their listing, even with your permission.

The owners of the property DO NOT own the rights and can’t just use them at will for their own purposes or to give it to their new agent, whether to sell the property or to lease the property without the written consent of the creator (Photographer).
